Legal Definitions by Ford Banks Irwin Solicitors - The Property Lawyers in Manchester

Please note: Not to be used or relied upon without legal advice. These notes are for illustrative purposes ONLY

Table A

This is a model form of wording for Articles of Association used by Company Law Solicitors and Lawyers to create a Limited Company.  The Solicitors will amend Table A in accordance with client instructions.

Talaq

This is the Islamic divorce.  The Talaq has relatively little legal implications for Family Law Solicitors and Lawyers although for the clients it can be the most important aspect of the separation.  There is no prescribed form of wording or procedure. The custom and practice varies around the World.

Term of Years Absolute

This is another way of describing Leasehold Property.  Property Law Solicitors and Conveyancers will explain the full grade of title on the Title Deeds to the clients.

Title Deeds

Documents that establish the ownership of Property.  Property Law Solicitors and Conveyancers will examine the Title Deeds when acting for the Buyer / Seller of the Property

Tomlin Order

See also Part 40 Civil Procedure Rules.  A Tomlin Order is a prescribed form of Court Order used by Litigation Solicitors and Lawyers to give effect to an agreement.  The Court Order usually provides for the Court Proceedings to be stayed on the agreed terms except for the purpose of enforcing or giving effect to the terms of the Court Order.

Transfer Deed

This is the actual document used by Property Law Solicitors and Conveyancers to transfer a Property.  It has to be in a prescribed form to be acceptable to HM Land Registry.

Tree Preservation Order

The Local Authority impose Tree Preservation Orders on Trees for the benefit of the local area.  This prevents any felling of the tree.  The client should ask the Property Law Solicitor and Conveyancer about the implications of a Tree Preservation Order if they are concerned about any local trees.

Trust Deed

A Trust Deed is used to create or amend a Trust.  A Trust is an arrangement where Property is held by Trustees for the use and enjoyment of the beneficiaries.  Solicitors and Lawyers are ideal candidates if you are looking for someone to appoint as Trustees.   See also Trust of Land.
