Transfer of a House / Flat / Apartment
 
Historical copies of the Property Deeds or Deeds plan held in electronic form 

Section 69 Land Registration Act 2002 allows the Registrar to provide information about the history of a registered Property. Under rule 144 LRR 2003 Conveyancing Solicitors and Property Lawyers may apply for copies of earlier editions of the Property Deeds or Deeds plan of any Property where they are held in electronic form.

If Conveyancing Solicitors and Property Lawyers wish to apply for a copy of the Property Deeds or Deeds plan containing historical information, they must do so on form HC1.  The Current Land Registry Fee Order will give details of the fee payable.


What information is available

Not all the information Land Registry hold is available in electronic format. Copies of historical registered Property Deeds may not provide a complete record of all transaction made. A single application containing more than one transaction or a  number of applications processed at the same time may result in the Property Deeds reflecting the final transaction only.
- Property Deeds historical information may be available for dates after May 1993;
- Deeds plan information may be available for dated after October 2003. Limited information is held about Deed plans before this date.


Completing form HC1:
Conveyancing Solicitors and Property Lawyers should complete form HC1 indicating whether they require either:
- a copy of the last edition of the Property Deeds or Deeds plan that existed on a specified date, or
- a copy of all editions of the Property Deeds or Deeds plan that existed on a specified date.

Land Registry may return the application unless the Conveyancing Solicitors and Property Lawyers supply a full date containing:
- year
- month
- day.


What if the information sought is not available in electronic form

If Land Registry do not hold the information Conveyancing Solicitors and Property Lawyers require in electronic form, they may hold papers copies of earlier editions of the Property Deeds or Deeds plan and they may be able to assist the Conveyancing Solicitors and Property Lawyers and provide them with copies if they apply in writing under the Freedom of Information Act 2000.

If Conveyancing Solicitors and Property Lawyers are unsure as to the exact nature of the information to apply for Land Registry recommend they make an initial enquiry by letter and that they provide:
- as much information as possible about the enquiry;
- the reason why the information is required.
This will enable Land Registry to determine if they are able to provide the information requested.


Personal inspection at a Land Registry Office

Conveyancing Solicitors and Property Lawyers can make a personal application at any of the Land Registry offices.  If they are making a request under the Land Registration Rules 2003 for information available 'as of right', the request should be made in form PIC.  Before visiting the Land Registry office, Conveyancing Solicitors and Property Lawyers are strongly advised to telephone to let them know what they would like to inspect and to make an appointment to visit.

Although Land Registry hold many documents in electronic form that can be seen at any of the offices, they also have millions of paper files that are held at different locations around the country. Making an appointment will allow the land Registry to obtain any of these files that are needed so that Conveyancing Solicitors and Property Lawyers are not disappointed when they visit.  

Land Registry offices are open to the public  from 8:30 to 6:00 Monday to Friday (excluding bank holidays during which time any person may make a personal inspection of the Property Deeds.

Inspection and coying should take place in the presence of Land Registry staff.
