Official copies of documents

If Conveyancing Solicitors and Property Lawyers apply through Land Registry online or the National Land Information Service they can also apply for an electronic official copy of a document referred to in the Property Deeds, where Land Registry holds the original in electronic format.

For applications for official copies made in accordance with the Land Registration Rules 2003 see the current Land Registration Fees Order for fees payable. Different considerations apply for requests for information made in accordance with the FOIA 2000.


Documents referred to in the Property Deeds

Conveyancing Solicitors and Property Lawyers should specify the document they require and its date. If the Property Deeds entry states that the document is filed under another title number, they should state this in the application, as it will assist in the processing of the application.

Please note that applications requesting 'all' or 'any' documents will be returned to the Conveyancing Solicitors and Property Lawyers.


Electronic official copies of Documents:
Conveyancing Solicitors and Property Lawyers using the Land Registry Direct and National Land Information Service may request an electronic official copy of a document referred to in the Property Deeds, where:
- Land Registry holds the original in electronic format
- the document is one that s not referred to in the section: Documents not available as of right   

Where an electronic copy has been requested but cannot be provided, such as where the document is oversize such as A2 or A0 or file size in excess of three mega-bytes a paper official copy will be issued by post.

The official copy will be issued in the form of a PDF file, which will include a lead page that forms part of the official copy.  In the Land Registry's view a print from a PDF file which includes the lead and all subsequent pages will be an official copy, provided the PDF file has not been modified or corrupted since receipt. If the PDF file is forwarded it will, provided it has not been modified or corrupted, constitute an official copy and a print from such an unmodified and uncorrupted PDF file will be an official copy.


How to check that the document received is an electronic official copy or a print from an electronic official copy: 

Conveyancing Solicitors and Property Lawyers need to be satisfied that the document is an official copy. Two considerations will help:
- does the document appear to be complete; are there any obvious discrepancies?
- did the document purport to come fro Land Registry Direct, the National Land Information Service or, if forwarded by a third party, is the standing of that person such as to make it likely that it is an official copy?


Documents not referred to in the Property Deeds:

If the Conveyancing Solicitors and Property Lawyers know the details of the document they require they should specify them in the application.  Otherwise they should provide as much information as they can eg 'the transfer to Mr and Mrs Manchester in 1964'.  Conveyancing Solicitors and Property Lawyers should avoid applications for 'all' or 'any' documents where possible. The word 'document' covers a wide range of papers as well as Deeds, such as correspondence, application forms and surveys. If Land Registry were to copy all the documents in the file for a specific title the fee could be quite substantial.

'Document' also includes electronic documents that may have been prepared as part of the process of creating or making changes to the Property Deeds.  Land Registry will not supply copies of these electronic documents unless the Conveyancing Solicitors and Property Lawyers specifically request them as, in most instances, they would add little to the overall picture and merely increase the fees.

Land Registry may contact the Conveyancing Solicitors and Property Lawyers by telephone in the first instance to establish exactly what copy documents are required, if it is not clear in the application.
