Transfer of a House / Flat / Apartment
Documents not available as of right
Applications by Conveyancing Solicitors and Property Lawyers for inspection or a copy of these documents should be made in writing including, in the case of the Freedom of Information Act 2000, by email. There is no requirement under the Freedom of Information Act 2000 for the Conveyancing Solicitors and Property Lawyers for the applicant to give a reason for requiring the information, but it may assist in cases where the public interest test needs to be considered by Land Registry.
Where a document has been designated as an exempt information document, an application for a full copy can be made using form EX2 in accordance with rule 137 Land Registration Rules 2003. See section on Exempting documents from the general right to inspect and copy. Conveyancing Solicitors and Property Lawyers can also apply in writing in accordance with the Freedom of Information Act 2000. See section: Rights under the Freedom of Information Act 2000. Please note that there may be some delay in dealing with these types of requests because Land Registry may need to serve notice on any interested party.
Land Registry will, however, always bear in mind its obligation to provide information under the Freedom of Information Act 2000 within 20 working days. If it seems likely that they are unable to meet this, they will inform each party in advance and give an estimate of the likely actual time it will take to deal with the request.
Schedule 5 applicants applying under rule 140 Land Registration Rules 2003 and using form CIT are entitled to all of the above documents as of right. (This rule applies to the police and certain other applicants) See section: Applications in connection with Court Proceedings, insolvency and tax liability for further information.
Applications and format of official copies
Whichever method of application Conveyancing Solicitors and Property Lawyers use, they can obtain an official copy in paper format. If they apply through Land Registry online or through any other Internet supplier such as the National Land Information Service they can also apply for certain official copies in electronic format. Official copies of the current Property Deeds and Deed Plan
Conveyancing Solicitors and Property Lawyers should use form OC1 when lodging a paper application. There is no longer a separate form for caution titles, so the OC1 may be used.
Where the Property is known to be registered and has a postal address (for instance 1451 Manchester Road, Altrincham, Cheshire) but the title number is not readily available, Conveyancing Solicitors and Property Lawyers may write "please supply the title number" boldly at the head of the form or in panel 2. Conveyancing Solicitors and Property Lawyers can then state the nature of the title in which they are interested in the second part of panel 2.
Land Registry will return 'please supply title number' applications with a non-postal address (for instance 'land on the west side of Manchester Road, Altrincham, Cheshire or 1451 Manchester Road and Land adjoining'). Land Registry will return 'please supply title number' applications which are accompanied by a plan even if the Property has a postal address. Land Registry will also return such applications where the number of title numbers revealed exceeds five. Where they return these applications to Conveyancing Solicitors and Property Lawyers they will normally request a search of the index map using form SIM.
Electronic official copies of the Property Deeds or Plan
Conveyancing Solicitors and Property Lawyers who use Land Registry online and National Land Information Service may request an electronic official copy of Property Deeds or Deeds Plan, caution register or caution plan, where Land Registry holds the original in electronic format.
Where an electronic official copy has been requested by Conveyancing Solicitors and Property Lawyers but cannot be provided, such as where the document is oversize (A2, A0 etc) a paper official copy will be issued by post or DX.
The official copy will be issued in the form of a pdf file. In the Land Registry's view a print from the pdf file will be an official copy, provided the pdf file has not been modified or corrupted since receipt. Also if the pdf file is forwarded it will, provided it has not been modified or corrupted, constitute an official copy and a print from such an unmodified and uncorrupted pdf file will be an official copy.
