Buying and Selling Leases
 
Bulk applications affecting one or more Land Registry Office

Large scale pre-completion applications (eg official copies and official searches)

There are two pre-completion services that Conveyancing Solicitors and Property Lawyers may choose to use before completion.
- investigation of title by obtaining official copies or viewing the register and/or plans
- searching the register to obtain priority.


Fees for pre-completion services

The most cost efficient way to obtain information is to use the Land Registry online services.

The fee for official searches or office copies of the Property deeds and deed plan requested online is roughly 50% more cost effective than making the same request by any other method.

For other pre-completion fees, Conveyancing Solicitors and Property Lawyers should refer to the Land Registration Fee Order.

There is no reduction in fees for bulk pre-completion services.


Calculation of fees for Large Scale applications

The fee is assessed under the fee order at the application.

Where an application affects 20 or more Property units the fee is payable under Article 6 of the fee order unless a greater fee would be payable under scale 1 (for first registrations and transfers on sale of Property), or scale 2(for Mortgages, transfers of mortgages and transfers of Property not on sale).

The fee under article 6 is the sum of:
- £12 for each of the first 500 Property units comprised in an application, and
- £6 for each additional Property unit over 500 units.

There is a maximum article 6 fee of £52 000 (£39 000 for voluntary applications) which applies to first registration applications.  There is no cap on registered Property.

The tables with examples A and B later in this section illustrate this formula.

Where the application is a large scale voluntary first registration, the fee order makes provision under article 2(6) for a 25 per cent reduction in fees. The examples below relate solely to compulsory registrations. Where there are voluntary first registration applications affecting a large area of Land or more than 20 individual voluntary first registrations Conveyancing Solicitors and Property Lawyers should contact the Register Development Team for guidance. 


Does Article 6 apply?

To decide whether Conveyancing Solicitors and Property Lawyers should assess the fee under article 6 Conveyancing Solicitors and Property Lawyers should ask themselves, in relation to each application that they intend to make:
- does the application relate to 20 ore more registered Property units?
- does the application relate to 20 or more unregistered Property units?

If the answer to both questions is 'yes' then the Conveyancing Solicitors and Property Lawyers will need to consider article 6.

If the answer to both questions is 'no' then article 6 is not relevant and Conveyancing Solicitors and Property Lawyers should calculate the fee under scale 1 or 2 in the normal way.

If 'yes' was the answer to only one of the questions, then Conveyancing Solicitors and Property Lawyers need to consider article 6 for that application and pay a scale fee on the application for which the answer was 'no'.
