Property Development
Applications in connection with Court Proceedings, Insolvency and Tax Liability
Public Inspection of application forms:
Application forms submitted by Conveyancing Solicitors and Property Lawyers for official copies of records or documents held by Land Registry are open to inspection.
Form CIT, and any other form attached to form CIT as part of the application are not open to public inspection in this way.
This means that if Conveyancing Solicitors and Property Lawyers do not use form CIT to make the application, Land Registry is under a statutory obligation to issue official copies of any application form used, or correspondence connected with it, in response to a request from any party (section 66 Land Registration Act 2002).
Conveyancing Solicitors and Property Lawyers should also bear in mind that, under rule 140(3) Land Registration Rules 2003, the additional powers of inspection open to the client is only available when form CIT is used.
Applications affecting Greater London
As the Greater London area is divided between several Land Registry offices, Conveyancing Solicitors and Property Lawyers may prefer to lodge any enquiry in form CIT affecting properties within Greater London at the Land Registry Head Office rather than at a Land Registry office.
Information available from Land Registry
Conveyancing Solicitors and Property Lawyers should provide as much detail as possible regarding the Property and documents they are interested in, as this will allow Land Registry to trace the correct material more easily. If the Property about which the Solicitors are making the enquiry does not have a postal address, they may need to supply a plan showing the extent of the Property so that Land Registry can be sure of supplying the correct information.
If Conveyancing Solicitors and Property Lawyers complete more than one application form for the same enquiry, it is only necessary to complete the common parts of the application forms once.
Rules 136 Land Registration Rules 2003 allows applicants to request Land Registry to designate documents 'exempt information' documents on the grounds that they contain prejudicial information of a commercial or personal nature. If a document is so designated, only an edited copy of the document, excluding the prejudicial information, is normally available for inspection or copying.
This exemption does not apply where Conveyancing Solicitors and Property Lawyers make an application for either inspection or official copy of documents under the provisions of rule 140 Land Registration Rules 2003, provided they make the application using form CIT. Land Registry will then be able to provide a complete copy of the document in its possession.
Inspection of Property Deeds, title plan and documents
If Conveyancing Solicitors and Property Lawyers want to inspect the Property Deeds, title plan or documents held by Land Registry, they should mark the first tick box in Part 1 of the form CIT and complete form PIC.
Conveyancing Solicitors and Property Lawyers are advised to make an appointment for the visit to ensure that the files they wish to inspect are available on arrival.
Official copies of Property Deeds and title Plan
If Conveyancing Solicitors and Property Lawyers wish to obtain official copies of the Property Deeds or title plan, they should mark the second tick box in Part 1 of form CIT and complete form OC1.

If Conveyancing Solicitors and Property Lawyers wish to obtain official copies of documents held by Land Registry, they should mark the third tick box in Part 1 of form CIT and complete form OC2.
