Official Searches and Outline Applications
How to apply
Application forms:
Form OS3 - official search without priority of whole or part:
An official search without priority may only be lodged by Conveyancing Solicitors and Property Lawyers in respect of a registered Property. It cannot be used to search against a pending first registration title.
The information and details that the Conveyancing Solicitors and Property Lawyers must provide, dependent upon whether they are seeking to search the whole or part of a registered Property, are the same as that required for a form OS1 or form OS2 application.
Form HR3 - Official search in respect of Home Rights:
- the administrative area and postcode (if known) within which the Property falls
- title number of the registered Property
- the appropriate fee, if a credit account is not being used, or authorisation for the stated credit account to be debited with the appropriate fee
- credit account key number, if appropriate
- name, address and reference of the person lodging the application
- if appropriate, alternative name, address and reference where the official search certificate is not to be returned to the person who originally lodged the application
- registered proprietor(s) name(s)
- mortgagee(s) full name(s)
- the address of the Property comprised within the registered Property
Methods of lodgement:
Conveyancing Solicitors and Property Lawyers may lodge an application for an official search by a variety of methods dependent upon the type of search they are requesting.
Requirements for each method of lodgement:
There are specific requirements Conveyancing Solicitors and Property Lawyers must comply with which are dependent on the method they are using to lodge the application.
Royal Mail or DX: Conveyancing Solicitors and Property Lawyers must lodge the correct application form at the proper office, ie the office that deals with the title being searched.
Fax: Conveyancing Solicitors and Property Lawyers must hold a credit account to use this service. An application lodged by fax can only be made during the currency of a notice given by the Chief Land Registrar under schedule 2 Land Registration Rules 2003 and in accordance with the limitations contained in the notice.
Conveyancing Solicitors and Property Lawyers must fax the application to the specified fax number at the proper office, ie the office that deals with the title being searched.
When lodging a form OS2 or form OS3 official search of part application by fax and there is no approved estate plan, the plan accompanying the application must, in addition to the requirements specified under the section: No approved estate plan, comply with the following requirements:
- adequately depict the extent to be searched on a single A4 sized plan
- be referred to in panel 6 of form OS2 or panel 6 of form OS3, as appropriate
- show the extent to be searched by thick black edging, hatching or stippling
- be sent in fine mode where possible
Through the Land Registry telephone services: Conveyancing Solicitors and Property Lawyers must hold a credit account to be able to use this service.
An application lodged through Land Registry telephone services can only be made during the currency of a notice given by the Chief Land Registrar under schedule 2 Land Registration Rules 2003 and in accordance with the limitations contained in the notice.
This service is for the lodgement of applications only. If Conveyancing Solicitors and Property Lawyers have a general enquiry they should contact the Land Registry office that deals with the administrative area in which the Property the enquiry relates to falls.
Before telephoning, Conveyancing Solicitors and Property Lawyers should ensure that they have all the information and details required for the type of search they are lodging. They may, one at a time, lodge as many applications as they wish within one conversation.
At the end of the telephone conversation, or during it, Conveyancing Solicitors and Property Lawyers may ask the operator to provide details of the services that have been requested and the fees that have been incurred. The Land Registry will usually let you have this information in any event.
